The Citizenship Act, states that for a person to claim citizenship by being born in Malta must either have:
a) One parent who is a citizen of Malta
b) Have one parent who meets the criteria for a person referred to in article 44 (4) (a) or (b) of the Constitution
In this case, the person applying for citizenship must provide proof of their Maltese descendants.

“Any person who on or after the appointed day marries a person who is or becomes a citizen of Malta shall be entitled, upon making an application in such manner as may be prescribed and upon taking the oath of allegiance, to be registered as a citizen of Malta.”
However, the person applying for the citizenship must submit proof that they have been living with and is married to a Maltese national for at least five years.
Maltese citizens who adopt a child from other countries can request the authorities to grant that child citizenship if they are under the age of ten at the date of the adoption.
A person is eligible to apply for Maltese Citizenship by Residency if, prior to your application, you have resided in Malta for a period of five years. You must also, have adequate knowledge of the Maltese or the English language and be a person of good character and standing with no criminal record.
Citizenship by Residency, most importantly, is at the discretion of the Minister. They will decide whether you meet the criteria and if they want to grant citizenship.
